What are my rights if I believe I have been wrongfully terminated?

Your rights as a wrongfully terminated person include the ability to file a complaint. However, you cannot be terminated on the basis of discrimination for several factors, including race, age, sex, sexual orientation and religion, among many others. 

How do I file a complaint for workplace discrimination or harassment?

You can file a workplace discrimination claim with the New Hampshire Commission for Human Rights (NHCHR) or the federal Equal Employment Opportunity Commission (EEOC). With either place, you’ll file a complaint first and the organization will investigate it. 

Can my employer retaliate against me for reporting illegal activities?

No. If you report illegal actions by your employer to the government, the law protects you from retaliation. Your employer cannot fire you, change your workload load or make your workplace hostile. You should be allowed to work normally, as if nothing had changed.

What are the requirements for receiving unemployment benefits?

In New Hampshire, to qualify for unemployment benefits, you must meet several requirements:

  1. Unemployment status: You must be unemployed through no fault of your own, meaning you didn’t leave your job voluntarily or were not terminated for misconduct.
  2. Wage requirements: You need to have earned a minimum amount of wages over a specific period of time.
  3. Active job search: You must be actively seeking new employment and willing to accept suitable work.

Meeting these criteria allows you to apply for and potentially receive unemployment benefits.

What types of compensation can I receive if I have been wrongfully terminated?

 If the EEOC or NHCHR investigation proves that you were wrongfully terminated, you may recover compensation such as:
